Terms of Service
Whitetail Wise Inc

These Terms of Service ("Terms") are a legal agreement between you and Whitetail Wise Inc ("Whitetail Wise Inc," "we," "us," or "our") governing your use of the Whitetail Wise Inc platform at app.whitetailwise.com and related applications (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you confirm you are authorized to bind that organization to these Terms.
2. The Service
Whitetail Wise Inc processes trail-camera photos, builds wildlife and buck profiles, maps hunting properties, generates habitat-stewardship plans and hunt predictions, and provides an AI assistant. Features and limits depend on your plan. We may add, change, or remove features over time.
3. Your account
You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity under your account. Notify us promptly of any unauthorized use. We recommend enabling two-factor authentication.
4. Plans, billing, and renewals
Plans and pricing. Paid plans are billed in Canadian dollars at the prices shown at sign-up. Applicable taxes (such as HST/GST) are added based on your billing province.
Free trial. New accounts may receive a time-limited free trial. At the end of the trial, your account becomes read-only unless you start a paid plan.
Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price for your plan, until you cancel. By subscribing, you authorize us, through our payment processor, to charge your payment method on each renewal.
Cancellation. You may cancel at any time from your billing settings. Cancellation stops future renewals; your plan remains active until the end of the current paid period, after which your account becomes read-only.
Changes and proration. If you upgrade, the change takes effect immediately and we charge the prorated difference. Price changes to your plan will be communicated in advance and apply at your next renewal.
Refunds. Except where required by law, payments are non-refundable. Annual prepayments may be eligible for a prorated refund less the cost of any usage-based services already consumed. Nothing in these Terms limits your rights under Ontario's Consumer Protection Act, 2002.
Usage limits. Each plan includes camera, property, retention, and monthly AI-analysis limits. On lower plans, uploads beyond the monthly limit are queued for the next period. On plans that permit overage, additional usage is billed at the disclosed per-photo rate.
5. Your content and trail-camera images
You retain ownership of the photos, property data, and other content you upload ("Your Content"). You grant Whitetail Wise Inc a limited license to host, process, analyze, and display Your Content solely to provide and improve the Service for you.
You are solely responsible for Your Content and for ensuring you have the right to upload and use it. You must comply with all applicable laws when capturing and uploading images, including recording, surveillance, privacy, and trespass laws. Trail-camera images may capture identifiable individuals; you are responsible for lawful collection and use of such images, including any material you compile to document trespass.
You must not upload content that is unlawful, infringes others' rights, or contains anything other than legitimate trail-camera and property data.
6. AI-generated output
The Service uses artificial intelligence to analyze images and generate detections, profiles, plans, predictions, and assistant responses. AI output may be incomplete or inaccurate and is provided for your information only. It is not professional advice. You are responsible for your own decisions, including all hunting, land-management, and safety decisions, and for complying with all hunting regulations and laws applicable to you.
7. Acceptable use
You agree not to: use the Service unlawfully or to facilitate unlawful hunting or trespass; attempt to access accounts or data that are not yours; probe, scan, or breach security; scrape, reverse engineer, or copy the Service; resell or sublicense access without our permission; or interfere with the Service's operation.
8. Intellectual property
The Service, including its software, models, design, and brand (including "Whitetail Wise Inc," "Raven Vision," and "The Raven"), is owned by Whitetail Wise Inc and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing. No other rights are granted.
9. Third-party services
The Service relies on third-party providers (including hosting, AI analysis, payments, email, SMS, mapping, and weather). Their handling of data is described in our Privacy Policy. We are not responsible for third-party services outside our control.
10. Data export and deletion
You may request access to, correction of, or deletion of your personal information as described in our Privacy Policy. Where your plan includes export, you may export your data. After deletion or account closure, we retain only records we are legally required to keep.
11. Suspension and termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to the Service. On termination, your right to use the Service ends; provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and governing law) survive.
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate. Nothing in these Terms excludes warranties or conditions that cannot be excluded under applicable law, including the Consumer Protection Act, 2002 (Ontario).
13. Limitation of liability
To the fullest extent permitted by law, Whitetail Wise Inc will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim. Some limitations may not apply to you where prohibited by Ontario consumer-protection law.
14. Indemnity
You agree to indemnify and hold Whitetail Wise Inc harmless from claims, losses, and expenses arising from Your Content, your use of the Service, or your breach of these Terms or of any law, including any unlawful capture or use of images of third parties.
15. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of Ontario have exclusive jurisdiction over any dispute, and you consent to that jurisdiction. This does not limit any mandatory consumer rights available to you under Ontario law.
16. Changes to these Terms
We may update these Terms from time to time. When we make a material change, we will update the effective date and, where appropriate, notify you and ask you to re-accept. Continued use after an update means you accept the revised Terms.
